Cancellation Policies: Once confirmed, the cancellation policies per the terms of the group tour programmes, customized tours and relevant travel services will apply. Please note, the above would apply for both general cancellation terms as well as covid related cancellations.
TERMS & CONDITIONS OF THE TOUR BOOKING
Please find below the policies, terms, and conditions of the tour bookings:
Details, Terms & Conditions:
• The Organizers will follow all country/state/city travel advisories during the tour and would regularly update the guests of the same.
• At the various properties, the relevant terms & conditions as well as safety protocols would apply.
• By way of confirmation of the bookings and payments, guests acknowledge that the Organizers would not be held liable for any cancellation charges or additional expenses which the guest’s may incur due to any change in the dates, rescheduling or cancellation of the programme. The Organizers may change the programme due to any reason including travel advisories, minimum group requirements, covid or security concerns that may arise prior or during the programme.
• Guests are requested to carry all necessary documentation as required for their travel, including Passports and Visas.
• Payment Terms - All statutory requirements and government guidelines will apply for payments. Government taxes and fees would be levied as applicable. In the event of any changes in government taxes or payment requirements, the Organizers will inform the guests of the same and will not be held liable for any changes.
• Bank Charges - Please note, any bank charges or fees if levied by the guests’ banks, would be undertaken by the guest
• Itinerary & Programme Details –The Organizers reserve the right to alter or change any element of the itinerary & programme if this is required for safety & comfort of the guests and this could be due to weather, security, covid, pandemic, government alerts or any other external conditions. In the event of any change in the itinerary or programme, the Organizers will not be responsible for any additional costs or liabilities incurred owing to the same.
• Please note, in the event of any damages to the hotel property or premises by the guest(s) during the stay, the concerned guest(s) will be held liable for any expenses or charges levied by the relevant hotel or other authorities due to the same.
• Payment & Cancellation terms are subject to change without prior notice
• Force Majeure: The Organizers will not be held liable for any cancellations or costs incurred by the guests due to conditions of force majeure which may lead to the inability to conduct the programme, suspensions or itinerary revisions. The conditions of force majeure include an act of God, war or security threats, strikes, lockouts, floods, travel lockdowns owing to pandemic conditions, earthquake, adverse weather conditions effecting access to the region or any other reason not within the control of the partners and parties organizing the programme.

Any services provided by and on JourneyMart are subject to the following Terms and Conditions (henceforth TAC). If you use this website it is deemed that you agree to all the terms and conditions that follow. There may be additional terms for particular features provided. On JourneyMart you can find valuable traveler information, search for and find travel and travel related products and services as displayed and book and buy online or offline from JourneyMart and its alliance partners. JourneyMart is not the end travel product/ travel service provider and hence is not directly responsible for the end delivery of the travel products and services being offered on the portal. Our aim is to make your search easy and accurate and to enable you to book and buy travel products and services conveniently through us and our alliance partners. It is our endeavour that your travel experience is a fulfilling one. The final delivery of the product / service lies with the end service provider (ie. Airline, Hotel, Cruise Line, Tour Operator, Travel Agent etc.) and JourneyMart disclaims all responsibility / liability for the same.

Definitions:
 JourneyMart: Or, JourneyMart.com , the portal/site you are on
JourneyMart Pvt Ltd: The parent company of JourneyMart
Legal Entity: A company / firm / individual/ person
Product / Service: A travel related product or service developed and sold by legal entities in the travel business and includes all travel related service rendered / to be rendered by a Licensee. Eg. Airline tickets, hotel rooms, tour packages, cruises, cars etc
User: Any person who accesses the website for any purpose including but not limited to transactions/ information / browsing
Associate/ Licensee/ Alliance Partner: Any legal entity who chooses to display/ sell a travel or related product on JourneyMart for the purpose of transaction
Force Majeure Event: It means, in relation to any Party, any act, event or circumstance, the cause of which is not of such Party's making nor within that Party's reasonable control, including (to the extent not of that Party's making nor within that Party's reasonable control) Act of God, war, hostilities (whether or not war has been declared) terrorist acts, acts of any civil or military authority, government or regulatory direction or restriction, suspension or withdrawal of licenses or consents, riot, insurrection, civil commotion, public demonstration, sabotage, acts of vandalism, fire, flood, earthquake, extreme weather conditions, epidemic, explosion, the order of any court or governmental or regulatory authority, disruption in transportation or communication, breakage of or accidental damage to equipment, any strike, lock-out, or other industrial trade dispute (not involving solely the employees of that Party), structural shift or subsidence, provided always that lack of funds shall not be interpreted as a cause which is not a Party's making nor within a party's reasonable control.

Right to Review and Amend etc.
JourneyMart has the right to review these terms and conditions and modify and/or change and update the same. Notice of such changes/modifications will be given pursuant to Clause 16 |
Duration
These terms and conditions, as amended from time to time, will apply for the duration that you use the website. |
Member Information
On registration with JourneyMart, you shall bind yourself to provide true and accurate and complete information in both optional and mandatory categories as required in the registration form or elsewhere. You shall be able to update such information by Writing to us at jm.editor@journeymart.com.
JourneyMart has the right to disallow you to transact on site if and when it has reason to believe that the information provided by you is incorrect, inaccurate or incomplete.
Due to the increasing number of internet frauds and to protect both the Card Holder and the Merchant, our risk management team reviews every online transaction and we are obligated to request and verify additional information from the card holder. Only on successful verification of the transaction is the same considered paid for. We may request you for additional documentation like scanned copies of your passport, front and back of your card, copy of your visa's / authority letter to authenticate your charge. When sending us the scanned front and back of your credit card please Black out the 3 CVV numbers on the back of your card without which your card cannot be misused.
Further please be advised the information provided by you is kept secure by us and not shared with any third party except when required by the bankers in case of any charge backs or as and when required by the law of the land and when voluntarily given by you at the time of requesting for a holiday showcased on JourneyMart by another Travel Service Provider.
We respect the need for securing the information you provide and all such information is protected and used by us as per our PRIVACY POLICY . This privacy policy binds only JourneyMart, its affiliates, employees and any third parties that JourneyMart deals with to provide any or all of the services rendered. Therefore you are advised to review and satisfy yourself as to the privacy policy of any associates where your personal information is requested.
In case you are still uncomfortable to provide us this information please let us know and we shall reverse your charge after debiting any cancellation charges if applicable.

Manner of Use

You agree that JourneyMart will not incur any liability for any loss or damage that you may incur due to using any service on that link or any transaction entered into on that other site. Indemnity
You agree to indemnify and hold JourneyMart and its subsidiaries, affiliates, officers, agents, and employees, harmless from any claim or demand, litigation costs, made by any third party due to or arising out of the Content you submit, post to or transmit through the Service, your use of the Service, your connection to the message board and communication areas or your violation of the TAC, or your violation of any rights of any other party.
Termination
JourneyMart has the right to disallow you from booking and/ or buying any products on the site; it may terminate or stall your account or use of the service at its sole discretion.
It may remove and discard any content within the Service, for any reason, including, without limitation, for lack of use, without notice.
Any actions on your behalf that violates or is inconsistent with the letter or spirit of the TAC will also make your account liable to be terminated. However you will be bound to clear all demands, if any, outstanding in your account.
JourneyMart may also, in its sole discretion and at any time, without notice, discontinue providing the service or any part thereof.
You agree that in the event that JourneyMart exercises its discretion under the provisions of TAC to terminate your account or any service provided by it such termination is effective, without incurring any liability and without any obligation on the part of JourneyMart to give prior notice.
The effect of the termination can be immediate deletion of your account and denial of access. Further all other data and files in your account may also be deleted.

Limitation of Liability
You expressly acknowledge and agree that JourneyMart shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if JourneyMart has been advised of the possibility of such damages), resulting from:
 the use or the inability to use the site or any service provided by it
the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service
unauthorized access to or alteration of your transmissions or data
statements or conduct of any third party on the service
any other matter relating to the site

Applicable Law/Jurisdiction
Jurisdiction for any disputes arising from and related to this contract shall be in Delhi for those raised by the user. The applicable law shall be that of India irrespective of the conflict of laws. |
Amendments to TAC
JourneyMart may amend this agreement on an as-needed basis by placing an update of this posting, and your continued use of the services following each updated posting shall be your acceptance of any such modification. Furthermore it is your responsibility to monitor the Terms and Conditions page of JourneyMart regularly to determine whether the Terms and Conditions have been modified. If you do not agree with the TAC of JourneyMart, or any modifications thereof to this agreement you must immediately stop using JourneyMart services. |
Entire Agreement
This agreement represents the entire agreement between the parties subject to the right of the portal to amend/delete/modify the contract under this agreement. |
