1. Right to Review and Amend etc.
JourneyMart has the right to review these terms and conditions and modify and/or change and update the same. Notice of such changes/modifications will be given pursuant to Clause 16
2. Duration
These terms and conditions, as amended from time to time, will apply for the duration that you use the website.
3. Member Information
On registration with JourneyMart, you shall bind yourself to provide true and accurate and complete information in both optional and mandatory categories as required in the registration form or elsewhere. You shall be able to update such information by clicking on My JourneyMart on the Home Page.
Journey Mart has the right to disallow you to transact on site if and when it has reason to believe that the information provided by you is incorrect, inaccurate or incomplete.
Due to the increasing number of internet frauds and to protect both the Card Holder and the Merchant Our risk management team reviews every online transaction and we are obligated to request and verify additional information from the card holder. Only on successful verification of the transaction is the same considered paid for. We may request you for additional documentation like scanned copies of your passport , front and back of your card ,copy of your visa's / authority letter to authenticate your charge.When sending us the scanned front and back of your credit card please Black out the 3 CVV numbers on the back of your card without which your card cannot be misused.
Further please be advised the information provided by you is kept secure by us and not shared with any third party except when required by the bankers in case of any charge backs or as and when required by the law of the land .
In case you are still uncomfortable to provide us this information please let us know and we shall reverse your charge after debiting any cancellation charges if applicable.
We respect the need for securing the information you provide and all such information is protected and used by us as per our PRIVACY POLICY . This privacy policy binds only JourneyMart, its affiliates, employees and any third parties that JourneyMart deals with to provide any or all of the services rendered. Therefore you are advised to review and satisfy yourself as to the privacy policy of any associates where your personal information is requested.
4. User Account, Password, Security
You will be required to choose a username and a password to enable use of your account. Keeping the username and password confidential and secure from misuse is entirely your responsibility.
Any transaction (as defined above) or use or activity from your account, giving rise to any liability, monetary or legal or otherwise, are your responsibility. Where you have reasons to suspect that there may have been unauthorized use of your account or any breach of security you must immediately inform JourneyMart. JourneyMart will not be responsible, under any circumstances whatsoever, for any losses that are incurred due to any misuse of your account by another, with or without your consent or knowledge or by yourself.
You must ensure that you exit your account when you end your visit to JourneyMart.
Also if any losses are incurred by JourneyMart or any other person due to misuse of your account by another it will be your responsibility and at your cost.
Legal Capacity
To transact you must have the legal capacity to enter into this agreement (i.e. You are above 18 years of age and are of sound mind ). JourneyMart does provide services that may well be availed by children/minors. If you allow children to use your account it will be your responsibility to monitor their use and liability will be yours in the event that there is breach of this TAC.
6. Proprietory Rights of JourneyMart and Restrictions on Use
Subject matter - Information, not in the public domain; software made available to use and/ or download; any name, symbol, device, phrase, sound, colour used as a distinguishing Mark to identify goods and/or services; any photograph, design, video clips, writings, illustrations, music, sound, found on the website.
Interzign Solutions Pvt. Ltd is the owner of all “ subject matter ” that are on the website in which intellectual property rights subsists.
The portal and its logo are registered trademarks.
Your use of the subject matter is restricted. You may not copy, reproduce, distribute, republish, down load, display or post (electronically or otherwise), transmit, record, reproduce without the prior written consent of the owner.
7. Restricted Use of Site
You are being given a limited license to use the site. It is a license to make personal use of it. You may not modify the site or any part thereof. The site or its contents may not be used for commercial purposes. The site or any portion thereof may not be reproduced/copied or otherwise exploited for the commercial purpose.
However you have the restricted right to download and print subject matter from this website for the limited purpose of using this website for a transaction/placing an order or other non-commercial and personal use.
Any breach of this term shall give JourneyMart the right to terminate this limited, non-exclusive license.

services. You agree not to use these services to harass, harm, abuse, defame, threaten any other person or body. You agree to abide by all the laws and regulations that may apply to online conduct. You agree not to use any vulgar, obscene or other offending contents when using these services.
9. Links
There are links to other websites on this site and these other sites are outside the control of JourneyMart. You agree that JourneyMart will not incur any liability for any loss or damage that you may incur due to using any service on that link or any transaction entered into on that other site. The fact that JourneyMart has agreed to have that link on its site does not imply any assurances or guarantees as to the quality and nature of goods and services being provided by that other site.
10. Indemnity
You agree to indemnify and hold JourneyMart and its subsidiaries, affiliates, officers, agents, and employees, harmless from any claim or demand, litigation costs, made by any third party due to or arising out of the Content you submit, post to or transmit through the Service, your use of the Service, your connection to the message board and communication areas or your violation of the TAC, or your violation of any rights of any other party.
Termination
JourneyMart has the right to disallow you from booking and/ or buying any products on the site; it may terminate or stall your account or use of the service at its sole discretion .
It may remove and discard any content within the Service, for any reason, including, without limitation, for lack of use, without notice.
ii) Any actions on your behalf that violates or is inconsistent with the letter or spirit of the TAC will also make your account liable to be terminated. However you will be bound to clear all demands, if any, outstanding in your account.
iii) JourneyMart may also, in its sole discretion and at any time, without notice, discontinue providing the service or any part thereof.
iv) You agree that in the event that JourneyMart exercises its discretion under the provisions of TAC to terminate your account or any service provided by it such termination is effective, without incurring any liability and without any obligation on the part of JourneyMart to give prior notice.
v) The effect of the termination can be immediate deletion of your account and denial of access. Further all other data and files in your account may also be deleted.
12. DISCLAIMERS
JourneyMart is the travel facilitator. However, it is not the end travel product or service provider itself and hence is not responsible in any manner whatsoever for any deficiency, delay, defect, error or any other shortcomings in the travel goods and services provided. JourneyMart disclaims all responsibility/ liability for the same.
You may transact if you expressly acknowledge and agree that:
your use of the services on the website or of the website in any manner is at your own risk.
the site is provided by JourneyMart on an “as is” and “as available” basis.
to the fullest extent permitted by applicable law, JourneyMart and its associates and affiliates, expressly disclaims all warranties, conditions and other terms of any kind, whether express or implied as to the operation of the site or the information, materials, products, services included on this site.

H. Advice or information, whether oral or written, obtained by you from the portal or through or from the service shall not create any warranty or other obligation not expressly stated in the TAC.

Limitation of Liability
You expressly acknowledge and agree that JourneyMart shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if JourneyMart has been advised of the possibility of such damages), resulting from :
the use or the inability to use the site or any service provided by it;
the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;
unauthorized access to or alteration of your transmissions or data;
statements or conduct of any third party on the service; or
any other matter relating to the site.
the failure of JourneyMart to perform their obligations under this contract where such failure is due to a force majeure event.

14. Applicable Law/Jurisdiction
Jurisdiction for any disputes arising from and related to this contract shall be in
Delhi for those raised by the user and concurrently with Delhi the geographical location of the user for disputes raised by Journey Mart. The applicable law shall be that of India irrespective of the conflict of laws.
15. Amendments to TAC
JourneyMart may amend this agreement on an as-needed basis by placing an update of this posting, and your continued use of the services following each updated posting shall be your acceptance of any such modification. Furthermore it is your responsibility to monitor the Terms and Conditions page of JourneyMart regularly to determine whether the Terms and Conditions have been modified. If you do not agree with the TAC of JourneyMart, or any modifications thereof to this agreement you must immediately stop using JourneyMart services.
17. ENTIRE AGREEMENT
This agreement represents the entire agreement between the parties subject to the right of the portal to amend/delete/modify the contract under this agreement.

COSMOS TERMS & CONDITIONS -PLEASE READ CAREFULLY
How to make your reservation
Just ask your travel agent to contact us with your requests and we will give immediate answers and booking options on the vacation(s) offered to you. All reservations must be made through your local travel agent.
Deposit and final payment
A non-refundable, non-transferable deposit of $200 per person, per vacation, is required for us to reserve space for you. Your payment is not considered made until it is received by Cosmos, Globus and Globus family of brands. Final payment is due 45 days prior to commencement of services. If we do not receive final payment by this date, we reserve the right to cancel the reservation. In the case of billing errors, we reserve the right to re-invoice with correct pricing. Bookings within 45 days to departure require full payment at time of confirmation of space.
Acceptance on the vacation is subject to presentation of the Traveler Certificate.
Cancellations and cancellation fees
If cancellation is received by Cosmos, Globus and Globus family of brands more than 45 days prior to commencement of services, the non-refundable deposit will be retained. For cancellations received within 45 days of commencement of services, the following per person cancellation fees apply:
45-22 days prior to commencement of services: 20% of total price
21-8 days prior to commencement of services: 30% of total price
7-1 days prior to commencement of services: 50% of total price
On departure day and later: 100% of total price.
Cancellation fees may also apply to any additional services, including accommodations, independently supplied services and optional excursions, reserved prior to, during and after the tour.
If flight changes, including flight cancellations, are requested, revision fees or airline cancellation fees will apply. If an air-inclusive vacation is canceled after air tickets have been issued, refunds will be processed after air tickets are returned to Cosmos.
Cosmos reserves the right to cancel or re-schedule any vacation departure. If cancellation is made prior to departure, the only responsibility of Cosmos will be to refund to the passenger the amount we have received for the reservation. We will try to re-book the same vacation with a different departure date, or a similar vacation. Where Cosmos has confirmed flights, we will try to confirm air seats for the selected new dates, subject to availability. Cosmos cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through Cosmos.
Travel Protection:
The above cancellation charges will be applied in all cases. We do urge you to take adequate travel protection, including cover against cancellation, as recommended by your travel agent.
Revision fees
A fee of $30 per transaction will be charged for any alteration or revision made to a reservation. Airlines penalties on vacations with internal air flights may also apply. A change to traveler name, vacation date or vacation itinerary within 45 days of commencement of services (65 days on vacations with an overnight train or cruise vacation) will be treated as a cancellation and new reservation; standard cancellation fees apply.
Participation
As you are traveling with a group of international travelers on vacations listed in the brochure or on the Web site, you are expected to conduct yourself in a manner that is not offensive to others or disruptive to the group and are expected to conduct yourself in a manner that is appropriate for group travel. For the benefit of everyone on your vacation, Cosmos, Globus and Globus family of brands reserve the right to accept or reject any person as a vacation participant, and to remove from the vacation any participant whose conduct is deemed incompatible with the interests of the other participants.
Travelers who need special assistance
You must report any disability requiring special attention to Cosmos, Globus and Globus family of brands at the time the reservation is made. Cosmos, Globus and Globus family of brands will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so, nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. Most transportation services, including the vacationing motorcoach, are not equipped with wheelchair ramps. We regret that we cannot provide individual assistance to a vacation participant for walking, dining, getting on and off motorcoaches and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance, and must assume total responsibility for the handicapped participant’s well-being.
Young travelers
Travelers who are less than 18 years old on the departure date must be accompanied by an adult. Children receive a 10% discount on the land price. We do not accept children who are less than eight years old. For special requirements regarding airline tickets for children, contact your airline directly.
Due to heightened security, many countries have adopted practices to prevent international abductions of children. If a child will be traveling with adults other than the parents or with only one parent, it is recommended that a notarized letter be written by the parents or non-traveling parent granting authorization to travel, including the dates of travel. We suggest that you also contact the appropriate consulate and airlines because they may have additional requirements.
Smoking
Smoking is not allowed on transportation that is exclusively provided by Cosmos, Globus and Globus family of brands.
Price Guarantee
All vacation prices are based on rates (including foreign exchange rates) known at the time of printing and expected to be in effect at the time of departure. Prices are subject to increase without notice if such rates change prior to departure. The current price will be confirmed at the time of the reservation. However, once Cosmos, Globus and Globus family of brands has received your deposit for any vacation departing in 2007, that land price is guaranteed, and any subsequent land cost increases are at our expense, not including surcharges and any government tax increases.
Vacation prices are per person, based on two persons sharing a room. Single room supplements and triple room reductions are listed where applicable.
Visas & Passports
A valid national passport is needed for all vacations and, as the various countries all have their own formalities, it is imperative that you check with your travel agent the visa requirements to enter the countries of the vacation you have chosen. Local consulates will also be in a position to give advice. You are responsible for obtaining and payment for all visas and entry documents, and for meeting all health and other requirements and any documents required by laws, regulations, orders and/or requirements of the countries to be visited. Multiple-entry visas are required for some vacations. All passengers traveling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip.
Passengers are responsible for getting their own visa’s and must ensure that they can obtain these visas before entering into a booking commitment with us.
Accommodations
The accommodations listed in the brochure or on the Web site are intended to be used on all departures; however, if a change becomes necessary for any reason, the accommodations substituted will be equivalent in standard to those shown. Every effort is made to reserve only twin-bedded rooms. It may occasionally happen that an accommodation provides some double-bedded rooms instead. These rooms will be allocated to couples where possible.
Please note that accommodation check-in times vary worldwide. Triple-room configuration is at the discretion of individual hotels.
Private bath and single rooms
In exceptional cases where private bath or single rooms as reserved by us are not available, refunds will be made by the Tour Director or Local Host. Claims made in this respect cannot be accepted after the vacation is complete.
Baggage allowance
Porterage for one suitcase is included in the vacation price. Airport porterage at the beginning and end of the vacation is not included. Due to limited coach capacity, this single bag should have dimensions not exceeding 30"x21"x11" and weight not exceeding 50 lbs. (22kg) or less if your air carrier has stricter weight/dimension limitations. We regret we are unable to accept a second suitcase or any luggage exceeding these limits. We recommend you consult your air carrier as size and weight limitations vary from airline to airline and even according to destination, and are becoming more restrictive. Cosmos, Globus and Globus family of brands is not responsible for additional fees imposed by air carriers. Regulations within most airports require that travelers handle their own luggage through customs.
Carry-on bag should not exceed the dimensions of 12"x11"x6". For safety reasons, wheeled carry-on bags are not suitable as hand luggage on motorcoaches and mini-buses.
No responsibility is accepted for loss of or damage to baggage or any of the vacation participant’s belongings. Baggage insurance is recommended.
Travel documents
Travel documents are sent to your travel agent approximately two to three weeks prior to departure from your home country, provided full payment has been received. A $15 charge per reservation is required for documents requested in advance.
Not included in the vacation price
International Air Transportation Tax; agricultural tax; any other taxes; security fee; airport taxes and fees; port taxes; passports; visas and vaccinations; tips to your tour or cruise director, tour host, tour driver, local city guides, ships’ crew; gratuities on ferries, trains and cruise ships; laundry; telephone; mini bar; alcohol, beverages and food not on the regular table d’hôte menu (these extra items will be billed to you before leaving the hotel, ship or restaurant); optional excursions; porterage at airports; travel protection; excess baggage fees; all other items of a personal nature.
Refunds
Please note that any request for refunds is subject to the terms and conditions of the brochure and the Web site; no refund can be made for unused services of less than 48 consecutive hours, for unused transportation where group activity tickets are involved, or for voluntary modifications made by the traveler.
Service inquiries after the vacation
If after returning from your vacation, you wish to inquire about any services provided, please ensure that all correspondence relating to those services is received by Cosmos, Globus and Globus family of brands, Traveler Services, Group Voyagers Inc. (see address below), within 60 days of the tour completion date. This will enable Globus to make a timely investigation.
Holidays
During local or national holidays, certain facilities such as museums and restaurants, sightseeing tours and shopping may be limited or not available. Alternatives will be offered whenever possible.
Safety
Please be aware that during your participation in vacations operated by Cosmos, Globus and Globus family of brands, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft or other means of transportation; the forces of nature, political unrest, acts of terrorism and accident or illness in remote regions without means of rapid evacuation or medical facilities. Cosmos, Globus and Globus family of brands will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Cosmos, Globus and Globus family of brands will use its best efforts to ensure that adequate measures are taken.
Responsibility
Group Voyagers Inc. located at 5301 South Federal Circle, Littleton, Colorado 80123, is an independent company (“the Company”) licensed to market and distribute travel products under the Cosmos, Globus and Globus family of brands, and arrange for the vacation services offered in the brochure and on the Web site, including transportation, sightseeing, and accommodations through independent contracts.
The carriers, accommodations, and other suppliers providing services are independent contractors and are not agents, employees, or servants of, or joint ventures with, the Company or its affiliates. All certificates and other travel documents for services issued by the Company are subject to the terms and conditions specified by the supplier, and to the laws of the countries in which the services are supplied.
If, after departure, the services included in the vacation cannot be supplied, or there are changes in an itinerary for reasons beyond the control of the Company, the Company will arrange for the provision of comparable services. Any resulting additional expense will be payable by travelers and any resulting saving will be refunded by the Company to vacation participants.
The Company reserves the right to accept or reject any person as a vacation participant, to expel any participant from the vacation, to make changes in the itinerary whenever the Company deems it necessary for the comfort, convenience, or safety of the participants, and to cancel a vacation at any time.
The vacation participant agrees that neither the Company nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing services, or any insurer or insurance administrator under the Travel Protection Plan, or of any other person.
Any dispute between the vacation participant and the Company directly or indirectly relating to the Terms and Conditions shall be first submitted to mediation at Denver, Colorado before a mediator mutually agreed to by the parties. If mediation is not successful, the dispute must be resolved by binding arbitration under Colorado law before the Judicial Arbiter Group or its successor located at 1601 Blake Street, Denver, Colorado 80202. The prevailing party shall be entitled to an award of costs and reasonable attorney’s fees. Any action to enforce the arbitrator’s decision shall be brought in the state or federal courts in the State of Colorado.
Arbitration against the Company must be commenced within one year following the date of tour completion. Neither the Company nor any affiliate shall in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damages.
No person, other than an authorized representative of the Company, by a document in writing, is authorized to vary, add, or waive any term or condition in the brochure or on the Web site, including any term or condition set forth in the preceding provisions.

Globus family of brands is a service mark registered in the U.S. Patent and Trademark Office.

Due to heightened security, many countries have adopted practices to prevent international abductions of children. If a child will be traveling with adults other than the parents or with only one parent, it is recommended that a notarized letter be written by the parents or non-traveling parent granting authorization to travel, including the dates of travel. We suggest that you also contact the appropriate consulate and airlines because they may have additional requirements.
Smoking
Smoking is not allowed on transportation that is exclusively provided by Cosmos, Globus and Globus family of brands.
Price Guarantee
All vacation prices are based on rates (including foreign exchange rates) known at the time of printing and expected to be in effect at the time of departure. Prices are subject to increase without notice if such rates change prior to departure. The current price will be confirmed at the time of the reservation. However, once Cosmos, Globus and Globus family of brands has received your deposit for any vacation departing in 2007, that land price is guaranteed, and any subsequent land cost increases are at our expense, not including surcharges and any government tax increases.
Vacation prices are per person, based on two persons sharing a room. Single room supplements and triple room reductions are listed where applicable.
Visas & Passports
A valid national passport is needed for all vacations and, as the various countries all have their own formalities, it is imperative that you check with your travel agent the visa requirements to enter the countries of the vacation you have chosen. Local consulates will also be in a position to give advice. You are responsible for obtaining and payment for all visas and entry documents, and for meeting all health and other requirements and any documents required by laws, regulations, orders and/or requirements of the countries to be visited. Multiple-entry visas are required for some vacations. All passengers traveling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip.
Passengers are responsible for getting their own visa’s and must ensure that they can obtain these visas before entering into a booking commitment with us.
Accommodations
TThe accommodations listed in the brochure or on the Web site are intended to be used on all departures; however, if a change becomes necessary for any reason, the accommodations substituted will be equivalent in standard to those shown. Every effort is made to reserve only twin-bedded rooms. It may occasionally happen that an accommodation provides some double-bedded rooms instead. These rooms will be allocated to couples where possible.
Please note that accommodation check-in times vary worldwide. Triple-room configuration is at the discretion of individual hotels.
Private bath and single rooms
In exceptional cases where private bath or single rooms as reserved by us are not available, refunds will be made by the Tour Director or Local Host. Claims made in this respect cannot be accepted after the vacation is complete.
Baggage allowance
Porterage for one suitcase is included in the vacation price. Airport porterage at the beginning and end of the vacation is not included. Due to limited coach capacity, this single bag should have dimensions not exceeding 30"x21"x11" and weight not exceeding 50 lbs. (22kg) or less if your air carrier has stricter weight/dimension limitations. We regret we are unable to accept a second suitcase or any luggage exceeding these limits. We recommend you consult your air carrier as size and weight limitations vary from airline to airline and even according to destination, and are becoming more restrictive. Cosmos, Globus and Globus family of brands is not responsible for additional fees imposed by air carriers. Regulations within most airports require that travelers handle their own luggage through customs.
Carry-on bag should not exceed the dimensions of 12"x11"x6". For safety reasons, wheeled carry-on bags are not suitable as hand luggage on motorcoaches and mini-buses.
No responsibility is accepted for loss of or damage to baggage or any of the vacation participant’s belongings. Baggage insurance is recommended.
Car Rental:
These Terms and Conditions contain a summary of some of the rental conditions. For full, detailed conditions refer to the conditions schedule in the car rental agreement. To rent a car, drivers must be 21 years of age with a valid driver's license. A medical certificate stating that the customer is fit to drive the vehicle they have booked for the duration of the trip is required for drivers over the age of 75. Collision Damage Waiver Fees are not covered for the rental car for your vacation. You may ask them to be covered when picking up your vehicle. Car rental terms and conditions are subject to change but usually do not include gasoline, tolls, ferries, additional insurance, taxes, infant seat charges, or surcharges for additional drivers. Rental days are calculated on a 24-hour basis. Early return of the vehicle does not entitle you to any refund of the unused portion of the rental. Fees associated with rental exceptions and/or late car returns are not covered in the vacation package.
Travel documents
Travel documents are sent to your travel agent approximately two to three weeks prior to departure from your home country, provided full payment has been received. A $15 charge per reservation is required for documents requested in advance.
Not included in the vacation price
International Air Transportation Tax; agricultural tax; any other taxes; security fee; airport taxes and fees; port taxes; passports; visas and vaccinations; tips to your tour or cruise director, tour host, tour driver, local city guides, ships’ crew; gratuities on ferries, trains and cruise ships; laundry; telephone; mini bar; alcohol, beverages and food not on the regular table d’hôte menu (these extra items will be billed to you before leaving the hotel, ship or restaurant); optional excursions; porterage at airports; travel protection; excess baggage fees; all other items of a personal nature.
Refunds
Please note that any request for refunds is subject to the terms and conditions of the brochure and the Web site; no refund can be made for unused services of less than 48 consecutive hours, for unused transportation where group activity tickets are involved, or for voluntary modifications made by the traveler.
Service inquiries after the vacation
If after returning from your vacation, you wish to inquire about any services provided, please ensure that all correspondence relating to those services is received by Cosmos, Globus and Globus family of brands, Traveler Services, Group Voyagers Inc. (see address below), within 60 days of the tour completion date. This will enable Globus to make a timely investigation.
Holidays
During local or national holidays, certain facilities such as museums and restaurants, sightseeing tours and shopping may be limited or not available. Alternatives will be offered whenever possible.
Safety:
Please be aware that during your participation in vacations operated by Cosmos, Globus and Globus family of brands, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft or other means of transportation; the forces of nature, political unrest, acts of terrorism and accident or illness in remote regions without means of rapid evacuation or medical facilities. Cosmos, Globus and Globus family of brands will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Cosmos, Globus and Globus family of brands will use its best efforts to ensure that adequate measures are taken.
Responsibility:
Group Voyagers Inc. located at 5301 South Federal Circle, Littleton, Colorado 80123, is an independent company (“the Company”) licensed to market and distribute travel products under the Cosmos, Globus and Globus family of brands, and arrange for the vacation services offered in the brochure and on the Web site, including transportation, sightseeing, and accommodations through independent contracts.
The carriers, accommodations, and other suppliers providing services are independent contractors and are not agents, employees, or servants of, or joint ventures with, the Company or its affiliates. All certificates and other travel documents for services issued by the Company are subject to the terms and conditions specified by the supplier, and to the laws of the countries in which the services are supplied.
If, after departure, the services included in the vacation cannot be supplied, or there are changes in an itinerary for reasons beyond the control of the Company, the Company will arrange for the provision of comparable services. Any resulting additional expense will be payable by travelers and any resulting saving will be refunded by the Company to vacation participants.
The Company reserves the right to accept or reject any person as a vacation participant, to expel any participant from the vacation, to make changes in the itinerary whenever the Company deems it necessary for the comfort, convenience, or safety of the participants, and to cancel a vacation at any time.
The vacation participant agrees that neither the Company nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing services, or any insurer or insurance administrator under the Travel Protection Plan, or of any other person.
Any dispute between the vacation participant and the Company directly or indirectly relating to the Terms and Conditions shall be first submitted to mediation at Denver, Colorado before a mediator mutually agreed to by the parties. If mediation is not successful, the dispute must be resolved by binding arbitration under Colorado law before the Judicial Arbiter Group or its successor located at 1601 Blake Street, Denver, Colorado 80202. The prevailing party shall be entitled to an award of costs and reasonable attorney’s fees. Any action to enforce the arbitrator’s decision shall be brought in the state or federal courts in the State of Colorado.
Arbitration against the Company must be commenced within one year following the date of tour completion. Neither the Company nor any affiliate shall in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damages.
No person, other than an authorized representative of the Company, by a document in writing, is authorized to vary, add, or waive any term or condition in the brochure or on the Web site, including any term or condition set forth in the preceding provisions.

Globus family of brands is a service mark registered in the U.S. Patent and Trademark Office.
